Terms of Service

The agreement between your organization and Nestio.ca for use of the platform.

Effective: September 1st, 2026 · Last updated: September 19th, 2026 · Applies to nestio.ca and the Nestio.ca platform.

1. This agreement

These Terms of Service (the "Terms") are a binding agreement between Nestio Inc ("Nestio.ca", "we", "us"), registered at 7849 Erasmus Wynd NW, Edmonton, Alberta, Canada, T6M 0S3, and the organization that subscribes to or uses the Nestio.ca platform ("Customer", "you").

By creating an account, starting a free trial, or using the Service, you agree to these Terms. If you are accepting on behalf of an organization, you confirm you have authority to bind it. If you do not agree, do not use the Service.

If you have signed a separate written agreement with us, that agreement governs where it conflicts with these Terms.

2. Definitions

  • "Service" — the Nestio.ca platform, its portals, APIs, mobile and web interfaces, and related support.
  • "Customer Data" — all data, records, documents and content you or your Users submit to the Service, including information about residents, applicants, owners and vendors.
  • "User" — an individual you authorize to access the Service, including your staff, and residents, owners and vendors you invite to a portal.

3. Accounts

You must provide accurate registration information and keep it current. You are responsible for your Users' activity, for keeping credentials confidential, and for promptly notifying us of any unauthorized access. You must be able to form a binding contract and must use the Service for business purposes.

4. Plans, trials and billing

  • Plans. Current plans, prices and limits are published on our pricing page and may depend on the number of rental units under management.
  • Free trial. Paid plans include a free trial of the length stated at sign-up. Unless you cancel before it ends, the subscription continues and billing begins.
  • Currency and billing period. Prices are in Canadian dollars and billed monthly in advance unless stated otherwise.
  • Taxes. Prices are exclusive of GST/HST and other applicable taxes.
  • Usage-based charges. Some features carry separate charges — including tenant screening, billed per applicant, and payment processing fees, disclosed before you collect a payment.
  • Price changes. We may change prices on at least 30 days' notice, effective at your next renewal.
  • Non-payment. If an invoice is overdue we may suspend the Service after giving notice and a reasonable opportunity to pay.
  • Cancellation. You may cancel at any time, effective at the end of the current billing period. Fees already paid are not refundable except where required by law.

5. Payments handled through the Service

Rent and other payments your residents make through the Service are processed by a third-party payment processor, subject to that processor's own terms. We are not a bank, money transmitter or escrow agent, and we do not hold your funds. Settlement timing, holds, chargebacks and reversals are determined by the processor and the payment networks.

6. Your data

Customer Data is yours. You retain all right, title and interest in it. You grant us a limited licence to host, process, transmit and display it solely to provide and support the Service and as permitted by our Privacy Policy.

You may export your records through the Service's export features while your subscription is active. On termination we will make it available for a reasonable period, after which we may delete it.

We may use aggregated, de-identified information that does not identify you, your Users or any individual to operate and improve the Service.

7. Your responsibilities

You are responsible for the lawfulness of the Customer Data you put into the Service and for how you use the Service in your business. In particular, you agree that:

  • you have the authority and any consents required to collect, upload and process personal information about residents, applicants, owners and vendors;
  • you will obtain the express consent required by applicable consumer reporting and privacy law before requesting a tenant screening report, and will use the results only for permitted purposes;
  • you will comply with the residential tenancy legislation, human rights legislation and privacy law of each province in which you operate;
  • you will meet your own accounting, tax and record-keeping obligations; and
  • you will send communications through the Service only where you are permitted to do so, including under Canada's anti-spam legislation.

8. Acceptable use

You must not:

  • use the Service unlawfully, or to discriminate against any person contrary to applicable human rights law;
  • upload malware, or attempt to gain unauthorized access to the Service, other customers' data, or our infrastructure;
  • probe, scan or load-test the Service without our prior written consent;
  • reverse engineer, decompile or copy the Service, except where that restriction is unenforceable by law;
  • resell, sublicense or provide the Service to a third party as a service bureau, except as expressly agreed; or
  • interfere with the integrity or performance of the Service, or use it to send unsolicited messages.

9. Third-party integrations

The Service can connect to third-party products such as accounting systems, electronic signature services, screening bureaus and payment processors. Those products are governed by their own terms and privacy policies. Enabling an integration authorizes the exchange of data needed for it to work. We are not responsible for third-party products, and a change or outage in one may affect related features.

10. AI features

The Service includes AI features that draft correspondence, triage maintenance requests and surface provincial compliance information. You acknowledge that:

  • AI output may be inaccurate, incomplete or out of date, and must be reviewed by a person before it is relied on or sent;
  • a person remains responsible for approving any action that binds a lease or moves money; and
  • AI output is not legal, accounting or tax advice.

11. Compliance information is not advice

The Service surfaces information about rent increase limits, notice periods and similar provincial requirements as a convenience. Legislation changes and circumstances vary. This information is not legal advice, we do not warrant that it is current or correct for your situation, and you remain responsible for your own compliance. Consult a qualified professional before acting.

12. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted operation. We may perform maintenance, and will try to schedule planned downtime outside business hours. We may add, change or discontinue features; if we materially reduce core functionality we will give reasonable notice.

13. Suspension and termination

We may suspend or terminate access if you materially breach these Terms, if your account is overdue, or if your use poses a security or legal risk. Except in urgent cases we will give notice and an opportunity to correct the problem. You may terminate at any time under section 4. Sections that by their nature should survive termination will do so.

14. Confidentiality

Each party may receive non-public information from the other. The receiving party will protect it with at least reasonable care, use it only for purposes of this agreement, and not disclose it except to personnel and advisers who need it and are bound by similar obligations, or where legally compelled.

15. Intellectual property

We and our licensors own the Service, its software, design and documentation, and all related intellectual property. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. Feedback you give us may be used without restriction or obligation to you.

16. Disclaimer of warranties

Except as expressly stated in these Terms, and to the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that it will meet your requirements.

17. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data, even if advised of the possibility.

Our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the fees you paid us in the twelve months immediately before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, or for death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, in which case the limitation applies to the extent permitted.

18. Indemnity

You will defend and indemnify us against third-party claims, and resulting damages and reasonable costs, arising from your Customer Data, your use of the Service in breach of these Terms, or your breach of applicable tenancy, privacy, consumer reporting or human rights law. We will notify you of any such claim and give you control of the defence, and you will not settle in a way that imposes obligations on us without our consent.

19. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in it, without regard to conflict of laws rules. The parties submit to the exclusive jurisdiction of the courts of Alberta, except that either party may seek injunctive relief in any court of competent jurisdiction.

20. General

These Terms, with our Privacy Policy and any order or written agreement between us, are the entire agreement between the parties on this subject. If a provision is held unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them to an affiliate or in connection with a merger or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.

21. Changes to these Terms

We may update these Terms. We will change the "last updated" date above, and for material changes we will give at least 30 days' notice through the Service or by email. Continuing to use the Service after the change takes effect means you accept the updated Terms.

22. Contact

Questions about these Terms can be sent to support@nestio.ca, or by mail to Nestio Inc, 7849 Erasmus Wynd NW, Edmonton, Alberta, Canada, T6M 0S3.
